Malema back in court over call to occupy land

Economic Freedom Fighters (EFF) leader, Julius Malema, is expected to back in the Bloemfontein Magistrates court on Friday for allegedly contravening the Riotous Assemblies Act.
Malema allegedly called on the red berets to occupy vacant land while adderssing supporters at the EFF's elective conference in Bloemfontein in December 2016.
The case against Malema was postponed in October last year after his defence brought an application in the North Gauteng High Court in Pretoria, challenging the validity of the charge and calling for the Constitution to be amended.
According to the provincial National Prosecuting Authority's Phaladi Shuping, the state was unable to proceed after the defence claimed that the Act on which the charges is based, is outdated and should not be applied in current South African law.
In a statement, the EFF wrote that their Commander in Chief will attend the hearing then proceed to George to a rally about the expropriation of land.
