Mpofu slams Kekana for being ‘dishonest witness’

The legal representative of suspended public protector Busisiwe Mkhwebane has described investigator Tebogo Kekana as a dishonest witness.

Kekana is being cross-examined by Dali Mpofu at the section 194 committee into Mkhwebane’s fitness to hold office. 


 

“Were you ever charged with being dishonest?,” Mpofu asked Kekana.


 

He answered: “No chair, I was found guilty of unauthorised disclosure of confidential information.” 


 

But Mpofu insisted there was a finding of dishonesty made against Kekana.


 

“I am asking you for the last time was a finding of dishonesty made against you by Mr Fourie, the chairperson of the disciplinary hearing?”


 

“Chair, I have made and submitted an answer to that,” said Kekana. 


 

A disciplinary hearing conducted by the Office of the Public Protector found Kekana to have been dishonest for disclosing confidential information.

According to the hearing chaired by a Mr Fourie, Kekana disregarded and breached the relationship of trust between himself and his employer by disclosing confidential information that was sent to him in error. 


 

The hearing also found Kekana’s position as shop steward with the Public Servants Association (PSA), and the advantage he could gain from the possession of confidential information, was more important to him than his duties as an employee. 


 

The final day of Kekana's testimony was not without drama.


 

Mpofu expressed dissatisfaction at the conduct of the committee and also accused the chairperson of failing to protect him.
