Magudumana’s urgent court application dismissed

Dr. Nandipha Magudumana's urgent application to have her arrest in Tanzania declared unlawful has been dismissed with costs.

Magudumana lost her battle to declare her arrest and deportation from Tanzania as unlawful.

Judge Philip Loubser handed down the judgment on Magudumana’s urgent application in the Free State High Court on Monday morning.

Magudumana was challenging her arrest and deportation from Tanzania in April.

Magudumana was arrested together with convicted murderer and rapist Thabo Bester in Arusha. 

She is accused of helping Bester escape from the Mangaung Correctional Centre in May last year. 

Judge Loubser told the court that the application is dismissed.

“I, therefore, find that the application cannot succeed. I make the following order, the application is dismissed with cost including the costs of two counts employees respectfully by the first to the third respondent and the sixth respondent."

Meanwhile, National Prosecuting Authority spokesperson Phaladi Shuping said there is a possibility of more charges being added.

“We are not going to concern ourselves with anything that is a possibility until such time that there is an appeal, it is only then we will respond because that is when they bring papers that we as prosecutors we will have to respond to but I think the judgement speaks for itself as at the end the High Court dismissed the applicants application.

“We have said it before that once there is an investigative process under way everything is a probability. There is a possibility of more people being charged and some charges being added against the accused but that depends on the investigation once it has been finalised.”
