AfriForum granted leave to appeal 'Kill the Boer' ruling
AfriForum has been granted leave to appeal the Equality Court ruling which declared Dubula ibunu (Kill the Boer/Kiss the Boer) not to be hate speech.
The Equality Court in August dismissed the hate speech case brought by Afriforum against the Economic Freedom Fighters over the singing of the struggle song.
AfriForum argued the song constituted hate speech and incitement to do harm.
But the court found that AfriForum could not prove that the song amounts to hate speech or incites violence.
The group lodged its complaint in October 2020 after supporters of the EFF sang “Kill the Boer, Kill the farmer” outside the Senekal Magistrates Court in the Free State, where the accused murderers of farm manager Brendin Horner were appearing.
A month ago, AfriForum filed an application to appeal the ruling in the Supreme Court of Appeal in Bloemfontein.
The lobbly group was granted leave to appeal on Tuesday.
Spokesperson Ernst van Zyl says in their opinion the case is of great importance.
“Today’s decision is only a single step forward in AfriForum’s great fight against the incitement of violence against farmers and minority groups. We will do everything in our power to ensure we defeat this dangerous, hateful behaviour.”
