Govt to appeal lockdown ruling

Government will appeal the high court ruling which declared the level 3 and level 4 lockdown regulations unconstitutional and invalid.
This was confirmed by Minister in the Presidency Jackson Mthembu on Thursday.
Mthembu addressed the media after a special cabinet meeting to discuss the ruling by the High Court in Pretoria.
“After obtaining legal advice and listening to numerous comments made by the legal fraternity in reaction to this judgment, we are of the view that another court might come to a different conclusion on the matter,” Mthembu said.

“Cabinet has therefore decided it will appeal the North Gauteng decision. Cabinet will ask that its appeal be heard in an urgent basis so that all of us can obtain certainty on the regulations.”
On Tuesday, Judge Norman Davis found that some of the lockdown regulations to be irrational and unconstitutional.
Davis gave government two weeks to review, amend and republish the regulations.
